Administrative Law Judge Rules in Favor of Foote’s Removal

WCBC News has learned that the Administrative Law Judge who presided  in the  case against Wayne Foote has submitted his opinion to the state board of education- and sources who have viewed the document report that in it-  the judge indicates the state effectively proved it’s  case for Foote’s removal. The Allegany County Board of Education in December of last year passed a resolution that asked the state board to remove Foote for misconduct in office and willful neglect of duty. The state board investigated allegations — in categories, including sexual misconduct, intimidation and breaching the confidentiality of board discussions in executive session — against Foote and determined they were legally and factually sufficient to support charges against him. For two days in late July, Administrative Law Judge Michael Wallace heard testimony from witnesses for the state and for Foote. He submitted his decision to the state board Tuesday.  Foote, and his attorney Thomas Lynch, have 15 days to file any  ‘exceptions’  or disagreements. That 15 day window will probably push the decision by the state board into October as the next meeting is set for September 24th.  If the state does act to remove Foote from the board-  he can appeal that decision to Circuit Court- but the court does not have to hear the appeal.  If an appeals process does take place, an interim board member would be appointed by the governor.

    As usual, Adyllotte has posted a story prematurely to incite gossip and rumor. It’s one of the few things he can do to get people to listen to his station. It could well turn out that Foote will be removed but the unverified sourcing on this article is very poor journalism which is why there is nothing in the Times-News.

    Are we suppose to be to stupid to under stand this report is not official? It maybe premature but the Times News will not report it because of ethics in journalism, they did not report it because they they do not know how to investigate and report local news. Unless someone spoon feeds them the article, you will not see it in print. I would rather have it out there for public consumption now as opposed to letting the powers that be have time to cover their tracks and put a spin on it.

    I liken the posting of this report to something you’d see on Facebook. And yes, the paper didn’t report it exactly because of ethics in journalism and respect for the parties involved.
