The Maryland Attorney General's office sees no problem with the State Police using non-departmental help from other state agencies to process the new gun application backlog.
WBAL reports that's the response to an inquiry last week from western Maryland Delegate Kevin Kelly who questioned the legality of using non state police employees for part of the job.
According to an official with the Attorney General's office there is no legal obstacle to the MSP using other staff to do that.
State Police have pulled in staff from corrections and other departments for the data entry phase but not background checks for the so called 77R forms.
Del. Kelly and others have expressed concerns that doing that violates the privacy of those making handgun purchases under current law…which is due to expire two weeks from today.
The letter, dated yesterday, is from Adam Snyder, Chief Counsel with Opinions, Advice, and Legislation in the Attorney General's office
