Arrest Made in Theft Case

On 06/10/2014 a Deputy with the Allegany County Sheriff’s Office received a tip that there was a large amount of property stolen from Allegany County, as well as property stolen from Morgan and Hampshire counties in West Virginia, located at Scrap Brothers, a scrap yard located in Paw Paw, West Virginia. The Deputy responded to that location and met with law enforcement authorities from the Morgan County Sheriff’s Office and the Hampshire County Sheriff’s Office. They obtained consent from the owner of the scrap yard to search the property.

During that search they recovered a stolen Husqvarna lawn tractor that had been stolen from Naylor’s Hardware on Industrial Boulevard in Cumberland earlier that morning. As they continued to search they discovered a large amount of property that they determined had also been stolen.

A request was made to the Allegany County Combined Criminal Investigation Unit (C3I) for assistance. Investigators responded to the location to assist in the investigation. The owner of the scrap yard was questioned and provided Investigators with the name of the individual who had sold the items to him. Based on this information, Investigators and Deputies responded to a private residence in Oldtown. A search of that residence was conducted, and additional stolen items were recovered.

As a result, Investigators charged 50 year old Donald Leo Fishel, of Oldtown, with Theft, related to the theft of the lawn tractor from Naylor’s. He was taken before a District Court Commissioner for an initial appearance and is currently being held at the Allegany County Detention Center on $5000.00 bond pending his next court appearance.

Investigators learned that numerous items had been taken from several residences in the Oldtown area. Among the items recovered are another Husqvarna lawn tractor, weed eaters, chain saws, lawn mowers, generators, and other power tools. Investigators have been able to identify several additional victims, but are asking anyone who may have been a victim and had items stolen from their residence to contact the C3I Unit, at 301-777-0326.

Agencies involved in the investigation include the Allegany County Sheriff’s Office, the Morgan County Sheriff’s Office, the Hampshire County Sheriff’s Office, and C3I. The investigation is continuing and additional charges are pending.
