Disturbance/Breaking & Entering Arrest

On September 29, 2015 at approx. 2:50 AM, officers from the Cumberland City Police Department responded to 325 Pennsylvania Avenue for a reported disturbance. Upon the officer’s arrival, entry was made into the apartment building. As the officers entered the building, they could hear a male subject yelling inside apartment #5. The officers also heard a female asking the male subject to leave her alone. This disturbance caused several tenants to exit their apartments. Officers made entry into the apartment through the front door. After entering the door, officers observed a female lying on the bed crying. Contact was also made with the male subject, Bernard Ferguson. Ferguson was identified as the subject creating the disturbance and later placed under arrest. Ferguson was transported to the Cumberland City Police Department. Ferguson was processed and issued a criminal citation before being released. On September 29, 2015 at approx. 7:29 AM, officers from the Cumberland City Police Department responded to 130 Polk Street regarding a male subject who was attempting to break into the residence. Upon the officer’s arrival, they observed Bernard Ferguson attempting to open the front door by wedging a piece of broken glass into the locking mechanism. Officers detained Ferguson while they spoke to the witness who reported the incident. According to the witness, Ferguson was observed at the Polk Street address attempting to gain entry. Ferguson was yelling at the time of the incident which caused the witness to look outside of her residence. Ferguson was placed under arrest and transported to the Cumberland City Police Department for processing. Ferguson was processed, served and taken before the District Court Commissioner. Ferguson was later released on his own personal recognizance. Arrested: Bernard Ferguson Age: 46 of Cumberland, Maryland Charge: Disorderly Conduct Charge of Second Arrest: Disorderly Conduct and Attempted 4th Degree Burglary.

Fugitive Warrant Served On September 29, 2015 officers from the Cumberland City Police Department responded to 26 Marion Street to assist the Pennsylvania State Police in locating, David Antoine Lee. Lee was currently wanted in the State of Pennsylvania on an outstanding warrant. Officers were able to locate Lee at the residence and he was taken into custody. Lee was transported the Cumberland City Police Department for processing. Lee was processed, served and taken before the District Court Commissioner. Lee was later taken to the Allegany County Detention Center where he was held awaiting extradition back to Pennsylvania. Arrested: David Antoine Lee Age: 27 of Cumberland, Maryland Charge: Fugitive from Justice.
