Foote Hearing Day One Wrap Up

Day One of the Maryland State Board of Education versus Wayne Foote is in the books, with testimony taken from current board member Tammy Fraley and former board members Laurie Marchini and Nicholas Hadley.  Others to testify in public included Allegany County Public Schools Chief Academic Officer Kim Kalbaugh, former Fort Hill Principal Joe Carter, and ACEA Uniserve Representative Evan West,  Two Fort Hill teachers were allowed to tesify behind closed doors. 

The hearing continues Tuesday at 9:30, with Assistant Attorney General Karen Anderson-Scott saying she should wrap up her segment by noon.  Office of Administrative Hearings Judge Michael Wallace is presiding.

Marchini spent nearly an hour on the stand, presenting detailed testimony of her allegation that Foote groped her during a P-TECH event at the Center for Career and Technical Education in October of 2017.  Current Academic Officer Dr. Kim Kalbaugh told the court of Foote making an inappropriate comment to her at the same event.  Foote was also accused of asking a Fort Hill art teacher if she would like to have his “artistic opinion” of her surgical scar.

Other points made by the prosecution focused on Foote breaching the confidentiality of executive sessions, including comments made to WCBC concerning the Bart Alan Mazer case at Mountain Ridge, the evaluation of Superintendent Dr David Cox, and passing notes to incoming board members who had yet to be sworn in

Defense attorneys Tom and Kelly Lynch spent much of the day clarifying testimony.  In his opening, Tom Lynch said that the process should never have been undertaken, in that the school board that brought the charges doesn’t exist anymore.

Tom Lynch suggested that the state board would be better off finding a clear path forward for the contentious local board, and that his client should take sensitivity training to adjust his behavior to the 21st century.

    Mr. Foote’s conduct was pretty crappy for any century. The possibility of him changing it is between slim and none. He was repeatedly warned about policies he choose to disregard in a most consistently despicable way. Second – the fact the previous board does not exist does not negate the reality of his actions. His ‘bad acts’ did not disappear with the old board. This lawyer does not appear to be an upgrade for Mr. Foote – I hope he had a money saving coupon for the fee.

    As the case rolled into the second day and summations, why were there no updates as there were on the first? It’s still rather bad news even if it is not reported. Reminds me of the rural phrase -”This ole dog don’t hunt.” Stay tuned.
