Hearings Against BoE Member Wayne Foote To Begin Tuesday

The state’s Office of Administrative Hearings will begin three days of hearings Tuesday in the case against Allegany County Board of Education member Wayne Foote.  The local school board in December passed a resolution that asked the state board to remove Foote from the panel. The state board investigated allegations- including sexual misconduct, intimidation and breaching the confidentiality of board discussions in executive session — against Foote and determined they are legally and factually sufficient to support charges against him. OAH Administrative Law Judge Michael Wallace has scheduled a public hearing on the case that will be held in bottom floor of the Allegany County Museum building on Pershing Street in Cumberland at 9:30 a.m. July 23 and 9 a.m. July 24 and 25.  If the hearing results in the state board removing Foote from office, he will have the right to appeal in Circuit Court
