The Cumberland Times News reports although the driver who led Garrett County sheriff's deputies on a 12-mile, high-speed chase in late February will not be prosecuted for first-degree assault, he faces numerous other charges.
Corey Austin Bircher, 23, Elk Garden, West Virginia, was in Garrett County District Court Monday for the first time following the Feb. 24 chase that began in Oakland and ended on North Hill Road in the vicinity of Kitzmiller.
"We entered nolle prosequi for only the first degree assault. The second-degree assault charge remains pending with all of the traffic charges," wrote State's Attorney Lisa Thayer Welch in response to a Cumberland Times-News emailed inquiry.
Nolle Prosequi is a legal term and in Latin means, “do not prosecute."
Bircher is also charged with:
• attempting to elude police
• driving while license suspended in another state
• driving an uninsured vehicle
• exceeding 90 mph in 40 mph zone
• first- and second-degree assault
• driving wrong direction on one-way road
• speed greater than reasonable
• reckless driving
• failing to drive right of center
• displaying registrations tags from another vehicle
• operating unregistered motor vehicle
No future court dates were listed for Bircher on the online Maryland Judiciary Case Search website.
When Bircher's 2005 Ford wrecked to end the chase, deputies discovered there was not only an adult passenger, but a baby in his vehicle as well.
