A man convicted 36 years ago in the fatal shooting of a Garrett County sheriff’s deputy is set for a plea hearing that could avert a retrial. The Cumberland Times News reports the hearing for 68-year-old Roberto Rezek is scheduled Friday in Hagerstown. He was convicted in 1980 of first-degree murder in the 1979 slaying of Deputy David Livengood in downtown Oakland. Rezek’s conviction was reversed in 2011 because his trial judge gave the jury improper instructions.
Rezek has always denied shooting Livengood. Co-defendant Richard Tichnell testified that he, Tichnell, fired the fatal shot after the deputy opened fire on the men during their robbery of an army surplus store.
Tichnell died in prison in 2006.
Rezek is from Fairmont, West Virginia.
