Keyser man assaulted, neighbor arrested

The Cumberland Times News reports a man was found lying bleeding in the street and a second man was arrested at the scene when Keyser Police responded to an altercation late Tuesday in the 400 block of Ward Avenue.

The victim reportedly suffered severe head trauma and was taken to Potomac Valley Hospital by Keyser EMS following the 11:30 p.m. incident. No information was available on his condition Wednesday.

Witnesses were reportedly present when police arrived and conducted an on-scene investigation, prompting the arrest of 32-year-old Joseph Scott Ervin on charges of malicious wounding and unlawful assault.

 

Ervin was processed for arrest by Keyser Police and taken to the Potomac Highlands Regional Jail in Augusta to await teleconference arraignment before a Mineral County magistrate.

Police said the incident was the apparent result of an ongoing dispute between the two men, who live about a block apart on Ward Avenue.

Police said the victim apparently was on his porch when he exchanged words with the suspect. The victim reportedly approached the front gate of the suspect's yard before the fight began.

 

Investigators said the alleged assault left the victim lying injured in the roadway and the Ervin returned to his residence. Minutes later, the suspect returned to the scene and allegedly assaulted the victim a second time.

The victim was reportedly "conscious but incoherent" when officers arrived and found him lying in the street.

The incident remains under investigation.
