State opinion says ex-officio member can attend closed sessions

According to an opinion from the legal counsel for the Maryland General Assembly,  an Allegany County Commissioner sitting as the ex-officio member of the Board of Education can attend closed, or executive sessions. Several board members last week expressed concern with Commissioner Bill Valentine recently attending the board's executive sessions and said they won'rt permit it. The commissioners threatened legal action. Delegate Leroy Myers sought an opinion from the GA and the response says there is no where in state law that prohibits the ex-officio member from attending those sessions.
