On Tuesday, January 14, 2014 the Cumberland Police Department arrested Jeremy Thomas Shurak and William Robert Bernier on active arrest warrants.  The warrants stem from a trespassing complaint which was filed on January 09, 2014.  On that date the Cumberland Police Department responded to a business located in the 400 block of Maryland Avenue in reference to the complaint.  Upon the officers arrival contact was made with a store employee who advised of three subjects entering the business and making threats.  Officers responded and made contact with the three suspects.  All of which were advised that they are no longer allowed on the business' property.  Almost an hour later the Cumberland Police Department were called back to the same business in reference to the same subjects entering the store.  All three fled prior to officer's arrival.  As a result charges were applied for through District Court on all three subjects.  Shurak and Bernier were served with the warrants which charge them both with trespassing.  Shurak and Bernier were then taken to District Court for their initial appearances.  Shurak and Bernier were both released on their personal recognizance by a District Court Commissioner.

 

The third subject was previously arrested on his warrant.

Jeremy Thomas Shurak – age 34 – Cumberland, MD

William Robert Bernier – age 24 – Cumberland, MD

Charges:

Arrest warrants charging Shurak and Bernier with Trespassing.

 

Death Investigation______________________Tuesday, January 14, 2014

 

On Tuesday, January 14, 2014 at approximately 4:18 p.m., the Cumberland Police Department responded to a residence located on Boone Street in reference to assist the Cumberland Fire Department who was on the scene due to a possible carbon monoxide poisoning.  Upon the officers arrival contact was made with personnel from the Cumberland Fire Department who advised that one subject was deceased inside this residence and another subject was in critical condition.  Investigators from the C3I unit were called to the scene to assume the investigation with the assistance of the Cumberland City Fire Marshall. 

The deceased is a 63 year old male of Cumberland, MD.  The subject in critical condition is a 67 year old male of Cumberland, MD.  This subject was transported to the Western Maryland Regional Medical Center for treatment, further details are not available.  Both names are not being released at this time out of respect for the families.

Initial investigation revealed that both males were working on the interior of the residence.  A gasoline powered generator and a kerosene heater were being used inside the residence which caused the carbon monoxide levels to become lethal. 

The investigation is ongoing by the C3I Investigations Unit.

 

Bench Warrant Served______________________Tuesday, January 14, 2014

On Tuesday, January 14, 2014 the Cumberland Police Department arrested Shelly Ann Nelson on a bench warrant.  The warrant charges Nelson with violating the conditions of her probation.  Nelson was served with the warrant then taken to District Court for her initial appearance and was released after posted a bond of $165.00.

Arrested:

Shelly Ann Nelson – age 39 – Frostburg, MD

Charges:

Bench warrant charging Nelson with failing to follow the conditions of her probation.

On Tuesday, January 14, 2014 at approximately 10:45 p.m., a Cumberland Police Officer on patrol observed a vehicle fail to stop for a red traffic signal located at Mechanic Street and Baltimore Street.  The officer stopped the vehicle and made contact with the operator who was identified as Brian Wayne Resseger.  While the officer was speaking with Resseger about the traffic violation the officer smelled the odor of Marijuana coming from within the vehicle.  A probable cause search was conducted which revealed a grinding device containing Marijuana residue.  Resseger was placed under arrest and transported to Police Headquarters for processing.  Resseger was then issued a criminal citation charging him with possession of drug paraphernalia and released pending further action at District court at a later date.

Brian Wayne Resseger – age 21 – Cumberland, MD

Charges:

Possession of drug paraphernalia.
