On February 18, 2014 at approximately 2:58 a.m., Cumberland City Police officers were dispatched to 320 Columbia Street for a disturbance complaint.  Officers responding to the area were informed that a subject was sitting inside a Pontiac Grand AM playing loud music.  Upon the officers arrival they could hear loud music coming from the suspect's vehicle which was parked in front of 320 Columbia Street.  Officers made contact with the driver, Daniel Erwin Smith 2nd.   When officers made contact with Smith they noticed an open and partially drank can of beer sitting in the console.   While officers were speaking with Smith about the complaint he was extremely uncooperative and continuously used loud and profane language toward the officers.  Officers were able to make contact with the complaint who informed them that prior to their arrival; Smith had been playing his music loudly in his vehicle which woke him and his children up.  He asked smith to turn the music down, however Smith turned it up louder.  Smith was placed under arrest and transported to the Cumberland City Police Department for processing.  Smith was later released after receiving citations for disorderly conduct, driving without a license, and consuming/possessing/ drinking an alcoholic beverage on public property.

Arrested: Daniel Erwin Smith 2nd                                  Age: 23 of Cumberland, Maryland

Charges: Disorderly Conduct, Driving without a license and consuming/possessing/drinking an alcoholic beverage on public property.
