Destruction of Property Arrest
On August 21, 2013 during the early morning hours, Cumberland City Police officers were dispatched to a private residence on Park Street in Cumberland in reference to a report of a man banging on the front door and attempting to gain entry into the residence. Officers arrived on the scene and observed suspect Gary Lee Smith, 34 of Cumberland on the front porch in front of the door. Further investigation into this incident revealed that Smith had caused damage to the victim’s door glass a result of his banging on the door. Smith was subsequently placed under arrest and transported to the Cumberland City Police Department where he was charged with the following:
Destruction of Property less than $500.00 – 1 count.
Smith was issued a criminal citation and released pending trial at District Court.
Domestic Assault Arrest
On August 21, 2013 Cumberland City Police officers were dispatched to a South Street residence in reference to a domestic assault complaint. When officers arrived on the scene they found the victim crawling out of the front door of the residence yelling for help, and they appeared to be injured. The victim immediately directed the officers to the rear of the residence and told them that the suspect in this case was attempting to flee. Officers were able to locate the suspect in the rear of the residence where he was detained and interviewed. During the interview the suspect then allegedly produced a false identification card and gave officers false personal information.
The victim in this case was interviewed and they alleged that the suspect had choked them, threw them to the ground, and drug them along the floor after an argument. Officers observed injuries on the victim that were consistent with this type of assault, and the injuries required treatment. Cumberland Ambulance personnel were summoned to the scene to treat the victim’s injuries.
After further investigation, the suspect in this case was identified as Michael Anthony Butler, 25 of Cumberland. Butler was placed under arrest and transported to the Cumberland Police Department where he was charged with the following:
Assault Second Degree – 1 count
Disorderly Conduct – 1 count
Obstructing and Hindering – 1 count
Reckless Endangerment – 1 count
Fraud- Personal Identification to Avoid Prosecution – 1 count
Butler was processed and taken before a Allegany Count District Court Commissioner for a bond hearing. Butler was subsequently held at the Allegany County Detention Center on a $5,000.00 bond.
