WCI Inmate Murder Sentenced

The Office of the State’s Attorney for Allegany County, the Honorable Michael O. Twigg, State’s Attorney, announced on Thursday, February 2nd, 2012, that Michael Rodell Boyer entered a plea to Murder in the Second Degree in the homicide of Timothy Davis.  Mr. Boyer was sentenced to 17 years consecutive to his current sentence. The sentencing was conducted by the Honorable Timothy Finan.  The sentence of 17 years consecutive was recommended by the State’s Attorney’s Office. 

Mr. Boyer was accused of murdering his cellmate, Timothy Davis, in the Western Correctional Institute on February 13th, 2011.  A correctional officer witnessed Mr. Boyer striking Mr. Davis with a television to the head.  When correctional officers entered the cell Mr. Davis was found to be in critical condition and was transported to the Western Maryland Medical Center where he was pronounced dead shortly thereafter.  Mr. Davis’ death was ruled a homicide by multiple injuries and blunt force injury by the Office of the Chief Medical Examiner.

Mr. Boyer was indicted by the Grand Jury of Allegany County in April 2011.  The case was investigated by the Maryland State Police Homicide Unit, the Internal Investigative Unit of the Department of Public Safety, and Maryland State Police Crime Scene Technicians.  The case was prosecuted by Frederick H. Voss of the Allegany County State’s Attorney’s Office.  Mr. Boyer was represented by Michael Stankan and James Elliot of the Office of the Public Defender. 

Mr. Boyer remains incarcerated in the North Branch Correctional Institution.  After today’s sentencing Mr. Boyer’s release date will be approximately 2068.
