Business Owner Cancels Rally

The Cumberland Times News reports, Fernando Smith, owner and operator of Pristine Pre-Owned Autos Inc., has canceled a rally he had planned outside the Mineral County courthouse and Pristine has filed a petition for contempt (civil) against Prosecuting Attorney Jay Courrier and State Trooper M.L. Travelpiece and an order to show cause.

Contempt means that there was noncompliance with a court order or rule that affects another person.

Pristine also filed a complaint for a writ of mandamus and a request for an injunction for the return of the business files and computers that were taken by the West Virgina State Police during an Oct. 23 search. A writ of mandamus is a petition to force a governmental entity to perform a nondiscretionary duty, according to Courrier. The hearing for the writ of mandamus and injunction will be held Dec. 1 at 9 a.m. in circuit court.
