Cumberland Man Arrested For Marijuana Possession

On Monday, April 1st, 2019, an officer with The Cumberland City Police observed a vehicle operating in the area of Park St with an inoperable tail light. A traffic stop was initiated on the vehicle and a K9 was called upon to conduct a free air sniff of the vehicle. The K9 positively alerted for the presence of a controlled dangerous substance inside the vehicle. During a subsequent search, a passenger in the vehicle was found to have in excess of 10 grams of suspected marijuana on his person. Paul Luther Kennedy, 35, of Cumberland MD, was arrested and charged with possession of marijuana more than 10 grams. He was taken before the District Court Commissioner for an initial appearance where he was released.

    Sadly, per the Baltimore Sun, had this man been arrested in Baltimore, the State’s Attorney there has issued a Declaration of No Longer Prosecuting Marijuana Crimes-regardless of the Amount! She’s even dismissed cases brought to her with more Pot than this! The Law is the LAW & per MD law it’s still illegal BUT there shouldn’t be a Dual Standard of Prosecution within a State & harsher penalties in 1 County but Nothing in another…just saying!
