Assault Arrest

On July 30, 2017 at approximately 7:00 PM the Cumberland Police responded to a residence on Bellevue Street for a disturbance.  When police arrived they learned John Joseph Nicol and an adult female had been involved in an argument that turned physical.  The altercation continued to an upstairs room and Nicol wouldn’t allow the female to leave the residence.  He then put his hand over the female’s mouth and nose.  The female was able to fight Nicol off of her and began screaming for help, hoping someone would hear and call the police.  A person in the area heard the yelling and called the police.  As police attempted to arrest Nicol he ran into the house and up the stairs.  As one of the officers attempted to place him under arrest he grabbed the officer by the shoulder and pushed the officer.  A brief struggle ensued and the officers were able to place him in custody without further incident.  Nicol was arrested and charged with two counts of 2nd Degree Assault, Resisting Arrest, False Imprisonment, and Fail to Obey.  The female sustained minor injuries that did not require medical treatment.  The officer did not sustain any injuries as a result of the incident.  Nicol was taken before a District Court Commissioner where he was held without bond.  He was taken to the Allegany County Detention Center pending his next appearance in District Court.
