Maryland State Police homicide investigators arrested an Allegany County man Saturday night and charged him with the murder of his infant child.
The accused is identified as Kyle J. Poindexter, 22, of the 12000-block of 6th Avenue, Cresaptown, Md. He is charged with second degree murder, first degree assault, second degree assault, and reckless endangerment.
The victim is identified as Avery Poindexter, two months old, of the same address. Avery was the newborn daughter of Kyle Poindexter.
On the afternoon of April 8, 2016, investigators from the Combined County Criminal Investigation Unit, Child Protective Services, the Maryland State Police Criminal Enforcement Division and the State Police Homicide Unit were contacted about the death of Avery Poindexter. The infant had been transported to the Western Maryland Regional Health Center in Cumberland earlier that day, where she had been pronounced dead. Medical personnel observed bruises on her head and face and notified police.
The preliminary investigation indicated the child's mother went to work yesterday morning and left the child in the care of her boyfriend and father of the child, Kyle Poindexter. She was notified in the early afternoon that the baby was being transported to the hospital. Investigators learned Poindexter had contacted neighbors, saying he needed help because the baby had stopped breathing. The neighbors began CPR while the father called 911.
After consultation with the Allegany State's Attorney's Office, State Police homicide investigators obtained a search warrant for the Poindexter home. The scene was processed by a State Police crime scene technician and investigators.
The victim's body was transported to the Office of the Chief Medical Examiner in Baltimore, where an autopsy was conducted today. Doctors ruled the cause of death was a head injury and the manner of death was homicide.
