Judge Affirms PSC Order Denying Wind Farm Certificate

We've learned through ANCHOR, the group opposed to locating 17 wind turbines on Dan's Mountain, that a ruling in support of the denial has been made in Baltimore City Circuit Court.

"On October 22, Judge Michael A. DiPieto affirmed the Public Service Commission’s Order dated June 16, 2017.    According to the opinion, the court finds that the PULJ and the PSC had substantial evidence to support the decision to deny the Certificate of Public Convenience and Necessity (CPCN) and had a rational basis for their application of the statutory standard.  

"In reviewing the Proposed Order and the PSC Order, this Court finds that Petitioner has not met its burden to overcome the presumption that the PSC properly exercised its discretion."

A recent reversal by the Allegany County Board of Zoning Appeals brought the proposal back into the news.

ANCHOR has sete public informational and discussion sessions for Tuesday, November 5th, at Bel Air Elementary School, and Tuesday, November 12th, at Midland Fire Hall.  Both issues are scheduled for 7:00 PM.
