Justice Sets Up Fast Track For Permits

Today, West Virginia Governor Jim Justice issued an executive order as a part of his continuing efforts to enact regulatory reform in West Virginia.
 
The executive order provides for an expedited process for all permits including:

  • Permitting for all projects.
  • Prioritization of permits for projects of critical economic concern.
  • Requiring executive state agencies to file written reports to the permit applicant, executive director of the state Development Office, and Governor, explaining inaction on completed permit applications for projects of critical economic concern.
  • Establishing an annual reporting requirement from the Development Office to the Governor and Legislature explaining whether the program is operating successfully.

“West Virginia has consistently been ranked at or near the bottom amongst all states for our regulatory environment by publications such as Forbes and CNBC. This is an area where we need to improve,” said Gov. Justice. “Like our President, Donald J. Trump, I have been very focused on regulatory reform and will aggressively continue those efforts in our state.”
 
Earlier this year the Governor signed two executive orders establishing a regulatory moratorium and regulatory review. Along with the passage of Senate bills 350 and 522, these actions all address over-regulation in West Virginia.
 
As a direct result of Gov. Justices’ recent regulatory reform efforts over 1,360 rules in the WV Code of State Rules have been repealed.
