Cumberland City Solicitor Michael Cohen has informed Mayor Ray Morriss and Councilman Eugene Frazier that in his legal opinion they should abstain from future votes involving CSX Transportation- but the mayor says he may appeal. Both Morriss and Frazier are retired from CSX and both are stockholders in the company. Cohen told WCBC News that the city’s Public Ethics Law, among other things, prohibits elected officials from casting a vote on a matter in which they have an interest. Morriss tells WCBC News that the law is somewhat vague and he will consider making an appeal to the Administrative Appeals Board…

Tough call. Nothing Morris and Frazier can do would move the value of their stock a penny in either direction. They were elected, in part because of their experience with the railroad. Certainly I understand the appearance of the conflict, but that is all it is – just an appearance. Hopefully a higher opinion can clarify the issue.
