Rawlings Woman Sues WV Agencies In Death Of Husband

Roberta Gares, of Rawlings, has filed a suit in Preston County Circuit Court, saying state agencies are at fault for the death of her husband at the Interstate 68 Welcome Center.

The couple stopped at the center on May 4th of last year, and were seated at a picnic table that had been brought out for additional seating when others at the table got up, causing the table to flip. 79 year old Walter Gares suffered injuries to his back, neck and head when he fell onto the concrete floor. The Department of Transportation says it didn't design the tables, and that the mishap was the result of naturally occurring conditions, or the negligence of persons or entities other than thay. WVDOT says the circumstances regarding the accident were unforeseeable.

Both parties have preyed a jury trial.
