Theft Arrest In Cumberland

On October 4, 2014, officers from the Cumberland City Police Department responded to Martin’s Market located at 739 Park Street for a suspicious person complaint.  Upon the officers arrival they made contact with the store manager.  Officers were advised by management that a white male was sleeping inside the café.  Officers learned that the male subject had obtained two containers of food from the buffet/salad bar area and had eaten it in the café without paying.  Officers made contact with the male and identified him as Gary Lee Smith.  While speaking with Smith the officers observed Smith to be intoxicated.  Smith told the officers that he had already paid for the food, but he had no receipts of payment.  After speaking with Smith, he stated that he did not pay for the food and did not have the money to pay.  As a result of this incident, Smith was placed under arrest and transported to the Cumberland City Police Department for processing.  Smith was issued a criminal citation and released pending his trial date in District Court.

Charge: Theft Less than $100
