Update: Pedestrian seriously injured, driver released from custody

On Tuesday  at 6:45 pm, Officers from the Cumberland Police Department responded to the 700 Block of Maryland Avenue for a pedestrian struck by a vehicle.  When officers arrived, they secured the scene and began investigating the accident while the Cumberland Fire Department tended to the victim.  Officers learned through the investigation that James Davis of Washington DC was operating a 2004 Pontiac northwest on Maryland Ave.  At this time the victim walked into the roadway and was struck by the vehicle operated by Davis.  The victim sustained serious injuries and was transported by Cumberland Ambulance to the Regional Medical Center. Furthermore, the investigation led to the suspicion of Davis operating the vehicle impaired. Subsequently Davis was arrested and charged with Driving While Impaired, Driving under the Influence, and Driving under the Influence of a Controlled Dangerous Substance.  After being arrested at the scene, Davis appeared before a district court commissioner, who released him on his personal recognizance, pending trial in district court. Police said further charges are pending in the investigation that includes the assistance of the Allegany County Sheriff's Office and an accident reconstruction specialist.
