WCBC interview among exhibits to be part of Wayne Foote hearing

The Cumberland Times-News reports it has obtained lists of witnesses and exhibits pertaining to an upcoming public hearing where the Maryland State Department of Education will try to remove Wayne Foote from the Allegany County school board. The local school board in December passed a resolution that asked the state board to remove Foote from the panel. The state board investigated allegations — which fall into categories, including sexual misconduct, intimidation and breaching the confidentiality of board discussions in executive session — against Foote and determined they are legally and factually sufficient to support charges against him. Foote denied the allegations and requested a public hearing on the matter.

Last month, OAH Administrative Law Judge Michael Wallace scheduled a public hearing on the case that will be held in Cumberland at 9:30 a.m. July 23 and 9 a.m. July 24 and 25.

In response to a CTN Public Information Act request, John J. Leidig — deputy director of operations, executive administrative law judge and custodian of records for the state’s Office of Administrative Hearings — via email said the state education department listed as witnesses:  

“Dr. Kim Green, Dr. Sara Bittinger, Ms. Laurie Marchini, Ms. Tammy Fraley, Mr. Nicholas Hadley, and Dr. David Cox.”

Additionally, Leidig said, MSDE listed the following exhibits:  

“Allegany County Board of Education Policies; Letter to Wayne Foote dated July 17, 2018; Letter to Wayne Foote dated October 9, 2019; Letter to Wayne Foote dated December 11, 2018; Letter to Wayne Foote dated June 14, 2018; Recordings of Allegany County Board of Education meetings; Recording of Wayne Foote on WCBC radio April 2015; Letter from MSDE dated February 26, 2019; and Board of Education members handbook. OAH is not in possession of any of these documents.”

Leidig said Foote listed the following witnesses:  

“G. Gary Hanna, Esquire; Braden E. Shober, Teacher; and Dr. Kim Green Kalbaugh, Chief Academic Officer for Allegany County Public Schools.”

Foote has not identified any exhibits.
