“Baylea’s Law” Increases Penalties For DUI Resulting in Death
West Virginia Governor has signed legislation significantly increasing criminal penalties for those convicted of driving under the influence causing death. “Baylea’s Law” is named for Baylea Bower who lost her life in 2023, being killed by an impaired driver. The new law establishes higher fines of up to $10,000 and a mandatory prison sentence of 5 to 30 years for those who operate a vehicle under the influence with deliberate disregard for human life…
“We’re establishing the new offense of Aggravated DUI Resulting in Death. A deliberate disregard for the safety of others is inexcusable and drug and alcohol impairment will no longer serve as a shield against the full weight of the criminal justice system.”
