Police make drug, dui arrest at Library parking lot

On August 13, 2015 an officer from the Cumberland City Police Department was on patrol in the area of the South Cumberland Library, 101 Seymour Street, when he observed a vehicle sitting in the library parking lot.  The officer observed the front seat passenger, later identified as Shaolin Bishop Murphy, holding what appeared to be a can of beer out the window; and a Bud Light beer box sitting on the ground directly outside the window.  The officer also noticed that the vehicle had a driver and a rear seat passenger.  After passing the vehicle the officer turned into the parking lot off of Pennsylvania Avenue to speak with the occupants.  While the officer was approaching the vehicle, he observed both the driver identified as Brian Michael Wilson, and Mr. Murray, to be reaching suspiciously around the vehicle.  Once the officer made contact with the subjects, he detected a strong odor of an alcoholic beverage emanating from within the vehicle.  The officer further observed Mr. Wilson attempting to reach toward the rear center console.  Based on the occupant’s suspicious activity, the officer instructed the front seat passenger to exit the vehicle.  While the officer was attempting to conduct a pat down frisk of his person, Mr. Murray began to pull away from the officer.  Mr. Murray was placed in hand restraints and the officer continued the pat down.   While conducting the pat down frisk of Mr. Murray’s person, the officer observed a silver digital scale inside a pants leg cargo pocket.  Mr. Murray offered consent to the officer to retrieve the scale from his pocket.  While the officer was examining the scale, he observed marijuana “shake” to be present on the surface of the scale.  As the officer turned to place the scale on the hood of his patrol unit, Mr. Murray began to flee from officers, on foot.  While several officers pursued Murray one officer remained with Mr. Wilson and a juvenile male passenger.   While officers were pursuing Mr. Murray the juvenile passenger exited the vehicle and fled on foot.  The driver, Mr. Wilson was detained.  During a lengthy search for both passengers, officers received information that Mr. Murray had entered a white in color passenger car.  The juvenile was later located at a residence on South Street.  Mr. Murray was later located inside the white passenger car on New Hampshire Avenue.  Mr. Murray was taken into custody at the scene and later transported to the Cumberland City Police Department for processing.  Upon further investigation into the incident, Mr. Wilson was placed under arrest for Driving under the Influence of Alcohol.  Additional charges are also pending against Mr. Wilson.  Mr. Wilson was placed under arrest and transported to the Cumberland City Police Department for processing.  Mr. Wilson was processed, served and later released to a family friend.  Mr. Murray was processed, served and taken before the District Court Commissioner.  Mr. Murray was held in the Allegany County Detention Center on $5,000 bond.  The Cumberland City Police were assisted by the Allegany County Sheriff’s Office and the Maryland State Police during this incident.

Charges: Disorderly Conduct, CDS possession of paraphernalia, Failure to Obey, Theft less than $100 and Obstructing and Hindering.

 

 

Arrested: Brian Michael Wilson                                    Age: 33 of Swanton, Maryland

 

Charges: Driving under the influence of alcohol and Driving while impaired by alcohol.
