Wednesday afternoon, the West Virginia Supreme Court of Appeals ruled in favor of the Potomac Highlands Airport Authority. In a 5-0 decision, the Supreme Court ruled that Terry Malone had failed to make a proper legal claim against the Authority
The Authority had required that Malone, the former airport manager, seek prior written approval before entering onto Airport property. Malone had filed a lawsuit seeking access to the property. Malone’s lawsuit was dismissed, and he appealed that dismissal to West Virginia' highest court in Charleston.
