Attorney For BoE Member Wayne Foote Officially Requests Hearing

The attorney for Allegany County School Board member Wayne Foote has officially requested a hearing in regards to charges issued last week. The State Board of Education issued charges of misconduct in office and willful neglect of duty in response to a resolution approved by the local school board in December-  asking that Foote be removed from office.  The charges focus on breaching confidentiality of the board’s closed sessions; and several incidents of sexual misconduct and intimidation.  George “Mac” McKinley, Foote’s personal attorney, had ten days after the state issued charges to request a hearing- and that was done on Monday. The next step is for the Office of Administrative Hearings to schedule a hearing. McKinley said he was surprised that the state apparently chose to issue the charges based solely on the accusations received.     This shows a lack of understanding of how the Board of Administrative Hearings works. The charges were made by the local board, the State asked for a response from Mr. Foote, and weighed both. At that point the charges were considered valid. The OAH hearing is to determine if the State acted correctly according TO ITS RULES. This is an administrative issue, not a criminal one.
