Circuit Court Date Set for ANCHOR Appeal

ANCHOR, the group opposed to the Dan's Mountain Wind Project says that the Circuit Court for Allegany County has set the date of Friday, August 14, 2020 for ANCHOR’s appeal for judicial review of the 2019 Board of Zoning Appeals’ decisions to grant Dan’s Mountain Wind Force, LLC variances, setbacks, and a special exception to build the project. 

The hearing will be held at the Allegany County Court House and is openeto the public, but only the attorneys for both sides will speak.

The circuit court judge's decision will be given at a later date.

    If the county didn’t need the million in revenue before, they need it now. Case was decided in October and takes until August for a hearing sums up everything wrong with govt

    Viewed the March 12, 2020 County Commissioner meeting on the YouTube. See how Jake and Creade treat people, especially women, when confronted with documented proof the Commissioners did not support the County’s Land Use Codes 360-107 in three court cases: 1. The Commissioners did not participate in the Maryland Court of Special Appeals in support of the Board of Zoning Appeals; 2. Only partially participate against Dan’s Mt’s PSC application in 2016 for turbines at 580 ft tall with 3.5MW generators. The Commissioners only argued for their preemption to rule the County as they pleased and provided NO testimonies, cross-examines, or arguments to protect the health, safety, and welfare of five communities adjacent to the Project; 3. And, the Commissioners did NOT participating in the 2017 Circuit Court for Baltimore City in support of the PSC denying a Certificate of Public Conveniences and Necessity to Dan’s Mt.
    At the end of the tape, Jake Shade admitted they did NOT participate because the County had paid $100,000.00 in attorney fees (proof not provide) and he decided not to spend anymore tax payers’ money on court cases. Over 2,300 residents live adjacent to the proposed Project and their qualities of life and health are at stake. Jake decided the communities/tax-payers on the Dan’s Mountain ridge were not worth defending even though we are part of 52% of the County’s population. The money the County would receive from the proposed project would not offset what the County will lose in the lost property values/taxes from the five communities. Prove me wrong; you can’t because I already ran the numbers.
    Creade Brode admitted he is related to a land owner who would have wind turbines on his property; let us open the conversation about conflict of interest and colluding with Dan’s Mt to benefit his relative by NOT following County’s Land Use Codes 360-107 and NOT participating in three court case to protect the five communities adjacent to the proposed project.
    Let us open the conversation about who has not been telling the truth and why the Commissioners have not following the oath they took when taking office to “…support the constitution and laws thereof…”; the Commissioners have proven they are more beholden to Dan’s Mt than the residents of Allegany County. I do NOT embellish or lie, I state documented facts! I am fighting to keep my home from becoming unlivable and unsellable. The 5 communities adjacent to the proposed project deserve the same quality of live you enjoy!
    Instead of being negative about everything, educate yourself about the facts & issues before you write comments. ANCHOR is going to win both cases because we represent truth and justice. What do you represent?

    Put it on the ballot and let the residents decide. My vote is to place the wind mills in the Chesapeake Bay, out of site out of mind. Leave our mountains alone.

    You wrote what is very likely the longest screed in WCBC history but yet couldn’t find the time to provide these numbers?

    Sure, let’s put it to a vote, delay this a little longer and cost the project even more money.

    As far as building them elsewhere, we really should be developing local power generation. Power produced locally is a very good thing to invest in, especially when it doesn’t pollute.
