On January 22, 2017 officers from the Cumberland City Police Department responded to Martin’s Market located at 739 Park Street for a shoplifting complaint.  Upon the officers arrival they were contacted by the store manager.  Officers were advised that a white male was inside the restroom eating items from the store that he did not pay for.  Officers were able to locate Gary Lee Smith inside the restroom consuming food that was taken from the store.  Smith was placed under arrest at the scene and transported to the Cumberland City Police Department.  Smith was processed and issued a criminal citation before being released.

Charge: Theft Less than $100

On January 23, 2017 at 1:52 AM, an officer from the Cumberland City Police Department was monitoring traffic in the area of Virginia Avenue.  While the officer was monitoring traffic, he observed a silver passenger vehicle fail to stop at a stop sign near Fourth Street.  The officer conducted a traffic stop on the vehicle and made contact with the driver, Gavin James Dehaven and a front seat passenger.  Upon the officer contacting the occupants, he immediately detected he distinct odor of marijuana emanating from the vehicle.  During a probable cause search of Dehaven, the officer located a plastic baggie containing Xanax pills a schedule 4 narcotic.  The officer also located a baggie of suspected marijuana weighing less than 10 grams.  As a result of the search, Dehaven was placed under arrest.  The front seat passenger was also searched and found to be in possession of a small baggie of marijuana.  The passenger was issued a civil citation and released at the scene.  Dehaven was transported to the Cumberland City Police Department for processing.  Dehaven was processed, served and taken before the District Court Commissioner.  Dehaven was released on his own personal recognizance.

Charge: Possession not marijuana.  Also issued a civil citation for possession of marijuana.
