BoE Counsel Says There Is Insufficient Evidence To Remove Foote From Board

A legal opinion rendered by the new, interim counsel for the Allegany County Board of Education has been posted online- and the conclusion is that there is not sufficient evidence or documentation to merit Wayne Foote’s removal from the board The document was generated by the law firm of Geppert, McMullen, Paye and Getty, and deals with the actions of the previous school board to ask the state board of education remove Wayne Foote for a number of reasons. Foote has been alleged to have made inappropriate remarks to a staff member of a school that has been blacked out in the correspondence, and is then said to have made comments which could be interpreted to be threatening.  He’s also been taken to task for revealing information from executive sessions, although there is a cited Attorney General’s opinion that state law does not impose a duty on board members to maintain the confidentiality of executive sessions. When contacted by WCBC News Tuesday morning, Foote declined to comment other than to say he was simply happy that the “truth” was now available for the public to see. Foote’s personal attorney George “Mac” Mckinley said he believes the summary by the board’s legal team exonerates Foote- and the entire matter now reflects poorly on the previous board and its last minute attempts to see him ousted…

 

Board President Robert Farrell declined to comment specifically on either the legal opinion or the resolution details- but did say he feels it was unfair of the previous board to take such an action just days before the new board was to be sworn in…

 

Farrell said he hadn’t gotten any information from the state board regarding the status of the Foote situation. Board members David Bohn, Deb Frank and Tammy Fraley declined to comment. State Board attorney Elliot Schoen did not return calls Tuesday.

    I wonder why the other board members don’t want to comment, especially Bohn, something shady is going on, I believe they have their own agenda

    Why would they want to comment? It is obvious to any person with any intelligence that the previous school board was shady. Dr. Cox needs fired immediately. And as a supporter of Ray Morris I am deeply disappointed in placing Marchini on the city council. She is bad news!
