Congresswoman April McClain Delaney (D-MD) released a statement after voting against H.R. 275, the House Majority's bill that would require DHS to publicly release a monthly report on the number of non-U.S. nationals encountered who potentially pose a threat to the U.S., the nationalities or country of most recent residence of those individuals, and the location of their encounter. “I opposed H.R. 275 because it poses real risks to our national security under the guise of transparency. While understanding and tracking potential threats is essential, this bill would require the Department of Homeland Security to publicly release sensitive operational data on a monthly basis—information that is currently protected for valid law enforcement reasons.
Publishing this information in near real-time could inadvertently aid those who seek to do harm. Criminal organizations and terrorist networks could use these reports to adjust their strategies, identify enforcement gaps and exploit routes that avoid detection. DHS classifies this information as Law Enforcement Sensitive precisely to protect sources, methods and our national security posture.
There is nothing preventing DHS from sharing relevant information with Congress or the public when it is appropriate. But mandating public release of intelligence-related data that could undermine our border security efforts is not just unwise—it’s nonsensical. We should be strengthening our security tools, not exposing them.”
