Attorney General Morrisey Files Motion to Intervene in Challenge to State’s Abortion Law

February 18th, 2023 by WCBC Radio

West Virginia Attorney General Patrick Morrisey on Friday filed a motion to intervene in a federal lawsuit challenging the constitutionality of the state’s abortion law.

The lawsuit, filed recently by the Women’s Health Center of West Virginia against the president and secretary of the West Virginia Board of Medicine, claims the state’s new abortion law violates the 14th Amendment of the U.S. Constitution.

“We have a strong case and we are ready to defend West Virginia’s abortion law to the fullest,” Attorney General Morrisey said. “As your first pro-life state Attorney General, I will stand strong for the life of the unborn and will not relent in our defense of this clearly constitutional law."

“I will always stand for the most vulnerable of our society and the sanctity of life.”

The lawsuit did not name the state or the Attorney General as defendants but the state has a “manifest legal interest in defending the constitutionality” of West Virginia’s abortion law.
