CPD Makes Assault & Trespassing Arrests

On Tuesday, January 30, 2018 at approximately 6:26 p.m. officers from the Cumberland Police Department were dispatched to a business on Queen City Drive for a theft.

Prior to the officer’s arrival the suspect fled the business pushing an employee out of her way as she was leaving. The suspect, Elizabeth Margaret Swain was located inside of CSX property on Queen City Drive.

As the officers were removing Swain from the train track area she swung her arm striking one of the officers on the face.

After a brief struggle with Swain she was placed under arrested.  A search incident to the arrested revealed several items of stolen property from the business.

Swain was transported to the station for charges and processing.  She was later presented before a District Court Commissioner for her initial appearance.

As a result of the hearing Swain was held at the Allegany County Detention Center on a $3,000.00 bond.

Charges:

2 counts of assault 2nd degree, Trespass on posted private property, Theft less than $100.00, Disorderly Conduct

 

 

On Tuesday, January 30, 2018 at approximately 7:42 p.m. officers from the Cumberland Police Department were dispatched to S. Central Avenue for a trespassing complaint.

Once at the residence the officers spoke with the complainant, who told the officers a male subject is inside of her residence and is refusing to leave.

The officers contacted the subject, Nathan Allen Herrell who was instructed by the officers to leave the residence.  Herrell refused to follow the officer’s directive resulting in his arrest.  Herrell was transported to the station for charging, he was later released on criminal citations pending trial in District Court.

Failure to obey a reasonable and lawful order

On November 22, 2017 at approximately 4:53 PM the Cumberland Police investigated an assault complaint in the 400 block of Ascension Street. The adult female victim told police she had been involved in an argument with an adult male family member at a residence. As the female was leaving the residence the male family member, Anthony Joseph Huff, began shooting at the female with an air soft gun from a second story window. Police were able
to locate the air soft gun and Huff was placed under arrest for 2 nd Degree Assault. He was also issued a municipal citation for discharging an air gun within the city limits of Cumberland. Huff was taken before a District Court Commissioner where he was released on an unsecured personal bond of $10,000. No injuries were reported in the incident.

Charges: 2 nd Degree Assault and municipal citation for Discharging an Air Gun
within the City Limits of Cumberland

Trespassing Arrest

On November 23, 2017 at approximately 2:21 AM the Cumberland Police were conducting a check of the gazebo area on Bridge Street when they located Earl Willis Robinette, Jr. in the gazebo. The area is a posted no trespassing area

between the hours of 11:00 PM and 7:00 AM. Robinette was arrested and issued a criminal citation for Trespassing
on Posted Property. He was released pending trial in District Court.
