Prehearing Conference Scheduled for Foote

A prehearing conference has been scheduled for Allegany County Public Schools board member Wayne Foote- and while not expected- the two sides could resolve the matter at that time. The former school board in December passed a resolution that requested the Maryland Board of Education remove Foote from office.  The allegations fall into the categories of breaching the confidentiality of board discussions in executive session, and sexual misconduct and intimidation.  Foot has denied the state's charges and denied the allegations and requested a public hearing on the matter. A telephone prehearing conference is now set for Wednesday, April 24th at the Office of Administrative Hearings in Hunt Valley. Foote’s attorney in this matter is George “Mac” Mckinley  who tells WCBC News that the purpose of a prehearing conference is an opportunity for the parties and  their attorneys to meet with an incumbent or senior judge of the Court designated by the Chief Judge” to discuss matters including case settlement and clarifying or limiting appeal issues”. While a resolution is possible, he doesn’t see that as a likely outcome…

 The Cumberland Times News reports that a  prehearing conference has been scheduled for Allegany County Public Schools board member Wayne Foote. The purpose of a prehearing conference is for the parties, their attorneys, or both to meet with an incumbent or senior judge of the Court designated by the Chief Judge” to discuss matters including case settlement and clarifying or limiting appeal issues.The former school board in December passed a resolution that requested the Maryland Board of Education remove Foote from office.  The state board later received two letters — from former local school board members — that support the removal request, as well as a legal memorandum prepared by the local board's counsel.  The allegations fall into the categories of breaching the confidentiality of board discussions in executive session, and sexual misconduct and intimidation.  Foote, via his attorney, responded to the state's charges, denied the allegations and requested a public hearing on the matter. John Leidig, deputy director of operations for the Maryland Office of Administrative Hearings, confirms that a telephone prehearing conference is set for April 24th.  Foote’s prehearing conference is public and will be held at 1 p.m. at the Office of Administrative Hearings, 11101 Gilroy Road in Hunt Valley.
